I'm new to the site, and have seen more and more stories coming out.
So far, each article I have read has mentioned one bank--the Bank of America. It seems obvious to me that scammers use the Bank of America on purpose--it is big, and their policies in teller training are lax. Scammers know it all depends on what the bank tells you. The recent Washington Post article had quotes from the bank-- they used the exact same words to him they did with me to deny responsibility. As soon as I could, I got out of bank of America, the the bank, Office of the Comptroller, and anyone I know knows why--My new Bank, Compass, has scam notices posted everywhere, and each teller I've worked with would never have 'Cleared' the check I was scammed with at Bank of America. Scammers print their counterfeit checks using Bank of America accounts on purpose.
Anyone know a lawyer who does class action suits? I think it's time to start one.
My bet is that most of those registered on this site were scammed with Bank of America checks. If that is true, a class action suit could be successful-it would show that one bank is more negligent than another.
At least, it would create awareness, and make policies change at Bank of America.
P.S.:
The scam I was victim to was from Nigeria--but I didn't know it until after I sent money to Amsterdam, then, they then asked for more money to be sent to Nigeria and I knew it...

We have tried that in the past. We even worked with someone at the law firm of Masry & Vititoe (the ones that Erin Brockovich work for) and nothing ever came of it.

I'm a former relay operator. I used to make calls for deaf people to hearing people. The nigerians hijacked IP Relay to make their phone calls to defraud businesses and individuals inside the US. But they also call banks. I can't divulge the content of any call, but let me tell you this. They use BOA. I've heard ASTOUNDING things coming from the telephone BOA operators. Very lax security. I know this for a fact.

I am one of the victims of Bank of America back in Nov. 25, 2004 about this fraud issue, bank of america did not notify me about the bounced checks after Dec. 10,2004. Three days before my husband surgery and a few days before christmas, imagine the pain I put my kids into, my eldest son even said "Santa forgot about me this year", you know how hurtful those words are hearing it from 3 years old. christmas that year and even now are still painful but we are hoping it will be better this coming year. Bank of america sent me a subpoena back in May of this year regarding this case and until now, I have not receive any notice whatsoever about the case but it sure did stop the collectors from harrassing me. I don't know what bank of america is doing but I am tired of waiting for this case to be solve. I have been trying to contact several attorneys but none of them are helpful. I have tried State Attorney's office but I failed; they keep denying my case because lack of Bank of America's cooperation in getting a certified copy of the bounced check. I am frustrated about this issue but until this is resolve, I cannot open an account because Bank of America reported this to Equifax putting my credit into lowest score you can possibly get. When someone sue for Bank of America, please count me in because they have put me in so much trouble you could imagine, I want them to pay me back for the lost time, effort and even my direct deposit that they took as part of my payment, I need those money back.
I hope some lawyers out there will have the guts to come out and pursue this case because whoever you are will be the hero of everyone of the victims of this fraud cases and will serve as my son's hero.

Until now my case with bank of america is still open; the attorney that keeps calling me to collect the money was not very nice and he even called me "naive"; he said I should have known better about it and I told him when you are desperate in having money just to feed your children, I don't think you would refuse such a good offer.

I was just a victim and the attorney does not understand that. It could have been avoided if Bank of America has a better system in handling fraud checks. It took then two weeks before they notify me about the bounce checks.

Right now, I don't want to look back in my past because it does hurt. I hope when you have class actions, please put my name as one of the victims; I still have all of the documents and emails from the person that did this.

Thank you Scamvictimsunited for creating my last christmas as the most wonderful and memorable for my children.

Have YOU spoken with a lawyer of your own at all? You might want to, especially if the BofA lawyer is not saying nice things to you. At the very least he would not be able to speak with you anymore because he would have to go through your lawyer.

I have contacted some lawyers in my area and the ones that you have listed before but none of them are able and willing to help me, I kept calling but no lawyers will take my case, they always tell me to go back to the bank and settle it with them; I don't want to pay those debts not becuase I don't want to but because I know this is fraud, I should not be liable for this one. If you know a lawyer that are handling the same case as I have, please give me the contact info so I can call them and see if they could help me. thank you

:x I too realize this is an older thread but I was also a victim of BoA in an alleged money laundering scam. To which there was never any follow up by BoA or their fraud unit or anybody else for that matter. Talk about guilty until you prove your innocence, that is me, now I am without any bank account anywhere with anybody to cash my paychecks I have to go to a paycheck cashing place and pay those outragious fees to do so. I was not personally victimized or lost any money but BoA ruined my credit and also said some very hurtfull things to me and about me. They froze my account long enough to allow overdraft fees (from my life insurance policies monthly payments) to add up to the amount of $204 and change then turned my info over to Telechex System and Experion and the other two credit agencies, now I'm ruined I can't even borrow enough money to pay attention. :cry:

If any lawyer should grow a set of BALLS and decide to file a class action lawsuit against BoA, Please add my name to the list. and if it is a matter of a lawyer needing to make money then I will most certainly donate my share of the procedds to him or her. :oops:

I know this is an old thread as well. I am to a new victim of check cashing fraud. my account was with boa. they did not inform me the checks had bounced until three weeks later. then they sent my info to all of the other banks saying that i committed check fraud. so my other bank being compass froze my account and then proceeded to close my account. then about a week later tuesday to be exact the boa overdraft service calls me and tells me that my account is negative 10600 and they want 4000 dollars a month for for months. i proceeded to tell her that I barely make 2000 a month. that i could not afford to pay this money back but would be willing to set up payments ( due to a lawyers advice in telling me to cooperate with them or they will arrest me) she kindly said no and then told me that this is not affecting my credit and that they have not reported anything to telecheck or check systems or even the credit bureaus. they just keep telling me to wait and someone will contact me. no one other than this lady has contacted me. she told me my account is to be closed finally on september 18th. and no action will happen until the account is successfully closed. I am going out of my mind. 10600 is alot of money. i have since contacted the police department and they said unfortunately this happens every day and there is nothing they can do except take a statement. then I called the attorney general and he said there was nothing he could do. the bank (boa) then finally told me that I would not be able to have any type of an account for 7 years. i have complete financial ruin and there is nothing i can do. Clearly bank of america should be held responsible. instead of helping their victims they pretty much screw you. and no lawyer will touch boa. because and I quote boa " our bank is the largest bank. and no lawyer will go up against us." said a manager.

Did the bank deposit the check into your account, or did you deposit the check into your account?

I am trying to figure out why you think the bank is to blame.
