Hello -

I have recently been scammed by a person I have known for a number of years and want to get awareness for what happened. Especially since this person has a history of doing these kinds of things. Being a good con, (they) are very good at getting your confidence and then twisting things afterwards to make the other party look like the bad guy. I was very sad when I realized what had happened.

I want to put up a website to get other victims to know that they are not alone and to warn people who may be getting near the situation what they are letting themselves in for. I have been told several times that this could create a lawsuit and other trouble, especially posting information that could identify this person. I have been looking at the web for other scammers and scam protection ideas and sometimes see identifying information on scammers posted out there.

My question - is posting your experience with a scammer grounds for legal problems? Is posting information that would identify the scammer to others illegal? And last, how are people that are doing this getting by with doing it (listing identifying information)?

Ideas anyone?

From my personal experience, yes, it could bring a lawsuit upon you.

In our case, we had to change every place on this website where we had the name of the bank we were with to then read "our former bank" and we can never mention what bank we had an account at when we were hit by our scam. But even with changing wording, our site still had a message to get out . . . about the scam of counterfeit casher's checks . . . for us, it was not about the specific bank, but about the way the scam works.

I am going to guess that you could use the "Freedom of Speach" to back your site. If you are at all worried about what legal action could be taken against you for publishing the information that you have on the internet, then I would suggest speaking to a lawyer.
