Finally! We thought we were in the calm before the storm and expected the next we'd hear from the bank would be a summons to appear in court....One year after the offer we made to BofA expired, they sent a letter accepting our offer to settle for one half of the amount. It is still going to cost us $3500 which is a lot of money, and I can't help but wonder if we should have offered less. But I feel buy accepting the offer they are at least willing to take on 1/2 of the blame. And from what we went through when this first started, that is a BIG step for them.
So far nothing has been reported to the credit bureaus, only chexsystems. We will be retaining the lawyer again, just to draw up a letter ensuring there will be no reporting to our credit, chexsystem is corrected and rewording from "suspected fraud" (making it sound like we frauded them) to "victims of fraud, settled in full, and we want a letter within 30 days stating the report to chexsystems will be updated. I think retaining the lawyer just to handle the correspondence made a difference. I honestly don't think we would have gotten anywhere if we would have sent the same exact letter withouth the lawyers letterhead.
