Post subject:  Counterfeit check

I guess I am here trying to figure out what all to do. I am the latest victim of a pretty popular scam accourding to my police dept. See we ( my husband and I ) were selling a truck, someone called and identified himself and where he lived ( Canada ) wanted to buy the truck and ship it to him... he sent us a bank one cashier's check via UPS and of course it was for to much money, he then later told us that his secretary messed up and would we please forward the remaining money to a person in Ohio to pick up the truck, we did, two days later my credit union calls and tells me its counterfeit and that I need to bring the all the money back ( THAT I NO LONGER HAVE ) after fighting with them for two days I am now still in the hole with them for about 3500.00 Isn't there some type of protection for us at all? could some one help me ?

Unfortunately here is the bottom line...... IF the bank although out of their own stupidity credited you the money ahead of final clearance ( the bank at the other end paying the check) and you spent that money, you owe the bank, there is no getting around that issue. The key here now is keeping your bank calm and coming up with a payment arrangement that is not going to break you into bankruptcy.

There is a common misconception that banks do little to nothing to dispell with consumers. That misconception is that if the money is credited to the consumers account the check must be good. NOT! The bank at the other end has to pay out on that check to your bank for it to reach final clearance. BUT even then it is not 100% fail safe, because the customer who's account the check was drawn on could after getting the next statement scream FRAUD if the check was not written by them to you.

IF you really want to know if that check is good, track down the account holder and ask them , did you write this check to me? if they say no, DO NOT put it in your account, immediately arrange for the check to get into the hands of the Authorities or the bank fraud department at the bank it was drawn off of.

If you are a victim of this scam, write a letter/summary of what happened to you (you can view mine at http://scamvictimsunited.com/our_story.htm )

Then go to http://scamvictimsunited.com/resources_ ... _check.htm and send that letter to every place on that list. I would also suggest sending that letter to the media to try and get even more attention to this scam and your case.
