I was also scammed on the Autotrader website and I have a lawyer who is wants to work on it but we need to find other victims. Please contact me at bjain100@yahoo.com ASAP.

Autotrader had nothing to do with the scam, neither did the bank. The scammer is the one everyone should be going after.

There are special situations in whihc the bank can be found at fault. One being the "midnight rule or law" see link http://www.aba.com/Compliance/DAFCsurvey_july2002.htm. In some cases the bank will see itself at half fault and settle for half of the money, it really depends on all of the circumstances that surrounded the cashing of the fake check. But it is rare (not unheard of but rare that a consumer wins fighting the bank).

According to that law you would not go after the bank you deposited the check with but the payee bank. You did realize that right?

Autotrader is not doing their job to protect its customers... if they had better warnings,etc... we would have been better informed consumers and thus not have fallen into these traps.

use your heads... think about it...

I have to ask you to SLOW DOWN! Autotrader is not "the bad guy" here. This could happen to anyone on any site that is selling anything Yes, the sites can help by posting warning to their customers, but do you read all of the fine print on all of the websites that you visit?

The general public needs to be educated that cashier's checks are not any safer than personal checks, and the outline of how these scams work. That is the only way that we will see less victims.

Shawn actually the word is getting out to some extent. In the last month or so Fraudaid has had victims come to us BEFORE touching money the bank put in their accounts.

That tells us that to some extent the word is getting out to be suspcious, we just have to fine tune this approach to include the fact that you should be suspicious BEFORE taking the check to the bank now.

That is great that some are getting the message in time, but I just want it to be clear that I do not think that making specific sites that offers items for sale out to be "the bad guy" is the right way to do this.

I have learned in the past 3 years since I became a victim of this scam that you get more help when you work WITH them on a solution rather than point the finger at them.
