 Post subject: Fake Check Scam- but the Bank is working with me

Hi Everyone!
I have been lurking here for a few days. I lost my job in March and was taken in by one of these CareerBuilder adds. I signed an Employee Agreement with this company- but they never did get my SS# or anything like that.

The first check was $3200.00- written on Wells Fargo checkstock. I took it to Wells Fargo and verified it and cashed it. That was May 2nd. It has never come back. Then my EMPLOYER requested I open a Wells Fargo account to make the process smoother. Three transactions later- I am in trouble. They look $2468.10 from my checking account.

I called the bank and here is what I found out.

They had checking numbers from OTHER Wells Fargo account holders. Also INNOCENTLY involved in the scam. Those three transactions were from people like you and me. When the people realized $900.00 or whatever was gone, they called the bank and had it reversed. THUS. I am now $2468.10 in the hole. You know the drill.. take the money and go to western union, yadda yadda. WHY was I so stupid?

Here is the good news. I called the manager of the bank that I cashed the first check at. He said I am no liable, THEY are. They verified the check- saw the funds were there and cashed it. I said what if it's fake and he said can't be- we cashed it. It has to be a washed check or a copy... and that will come back on us (the branch). So I am not liable, according to him for the $3200. He said I took it to the branch on good faith and I did.

SO- calling people and trying to do the right thing really does work and I happen to have a great branch manager. I now though, have to let that checking account go into collections. I don't have $2400.00
Does anyone know what happens when an account like that goes into collections or is charged off? I was thinking I could let it go for awhile and then maybe call and settle for less. They really SHOULD have some sort of protection for the consumer.

I also called Esperion and put a fraud alert on my SS# and told them what happened, in case this goes on my credit, which it will.

P.S. I am liable for the checking account- because funds were transferred IN and I spent them... I am not for the check because it was verified.

How is that my money orders were verified by the bank and the bank is stating that I need to pay that money back?

My bank is Wells Fargo.

Mind you, I figured out the fraud and went to officials and the bank still stated everything was still "hunky dory, no problems"

The money from the money orders was "made available" to you . . . it takes time for them to be truly verified as legitimate . . . that is why the scam works, because there is a time difference between when the bank allows you to use the money/gives you access to the money and when they actually know that the money is "good".
