After fighting my losses for 3 years now I'm finally getting somewhere. The UCC 4214 subsection (d)(2) states that a bank is Liable if they do not exersice ordinary care in cashing a item!
In many cases like mine these items are just copied good item's. That said there are alot of security features built into an item that Bank personnel are trained to look for. That said most Bank teller's do not really look at an item they just check that it was signed.

Does that override the portion in your deposit agreement that states you are responsible for what you deposit?

Banks have special knowledge of these scams that the general public does not or is late in receiving. The thing with cashiers checks that allow banks to pay them quickly is the security feature built into them that other checks do not have.
I beleive most of these cases are copies of a good cashiers check.
If you can get a hold of a good cashiers check from the bank that you got the scammed check from it's like night and day.
If you work at a bank you should be able to tell from your training!
