 Post subject: got scamed -- can I get money back from Bank?

My story is just similar to other people's. I am gonna feel so stupid if I think about it again. It's such a very expensive lesson. Anyway, my questions are:
1) I know bank is not resonsible for the counterfeit cashier's checks or money orders, but i think you are partially responsible for it. So I wonder if bank can refund at least the overdraft fee to me?

2) I talked to one of my friends' friend who used to be a lawyer, and he told me to write a letter to bank and ask them for money back because he said it's bank's duty to verify and honor those checks or money orders, but apparently they did not properly verify the money orders to determine their veracity. I am afraid what if bank comes to me and saying that I am the one who forged these money orders. This has been a big headache for me, and i do not want to get into any legal issue. Should I write a letter to the bank?

The bank teller really pissed me off the other day that I found I had negative balance, I went to bank & asked them about the details. The teller told me that any money order that is over $1000 should be fake, but she didn't tell me that when the day I deposited the money orders.
Now all money is gone...SO SAD :(

You are responsible for what you deposit, the bank gives provisional credit when you make a deposit, if something is returned against your account, then the overdaft is your responsibility.

If you look at your deposit agreement, at no point does the bank take responsibility for what you deposit.

Contact your banks fraud department, see if they will set you up a payment plan to reapay the bank.

i already paid bank back once i saw my account was negative. the thing that I am still really pissed off is that bank did NOT properly check the money orders to determine their veracity. yhe sadest thing is that the day these money orders got returned was my birthday, HOW SAD! i am still communicating with that guy, i think he is still trying to get more money from me. i am now just playing with him.

Many of us can relate to this. You would think that people who deal with money, checks and money orders all day would be able to determine if they are real or not. What I do not like is that when you ask when the check will "clear" they tell you when the money will be in your account, not when the check will be cleared through the system and determined GOOD.
